Scope

These terms apply to the website parkonaut.app and the Parkonaut apps for iOS and Android. The provider is Tobias Klüver (see the imprint). Parkonaut is free of charge.

By creating an account, you agree to these terms. Without an account you can browse Parkonaut and report errors. The sections “What is not allowed” and “User contributions” also apply to reports made without an account.

Account

Accounts are available from the age of 18, one account per person. You sign in with your Apple or Google account.

Do not share your access with others. If you notice that someone else is using your account, write to [email protected].

You can delete your account at any time in My area, on the website and in the app. You can export your data on the website first.

What is not allowed

Use Parkonaut the way it is meant to be used. In particular:

  • No false information about yourself and no additional accounts, for example to get around a suspension.
  • No automated requests or submissions using programs (bots, scrapers) unless we have allowed them.
  • No attacks on Parkonaut, for example with malware, by overloading it or by exploiting security vulnerabilities.
  • No circumventing our checks, limits or suspensions.
  • No purchased or coordinated ratings that distort the result.

User contributions

You can rate parks and attractions, write comments, report errors and suggest details. These rules apply to everything you submit to Parkonaut:

  • No insults, no harassment and no threats against other people.
  • No hate speech against people because of their origin, religion, gender, sexual orientation, a disability or similar characteristics.
  • No sexual content.
  • No depictions of violence and no incitement to violence or crime.
  • No content that glorifies self-harm or gives instructions for it.
  • Links only to sources that back up your information, for example the park website. No links to sites with malware or fraud and no URL shorteners.
  • Information to the best of your knowledge, no advertising and no spam.
  • Nothing that violates applicable law or infringes the rights of others.

Automatic check and moderation

Before we store rating comments, reports, suggestions and first names, we automatically check texts and links (see privacy policy). If a contribution clearly violates these rules, we do not accept it and tell you the reason straight away. Slightly problematic reports and suggestions are looked at by a person in moderation before we accept them.

If you think a rejection is wrong, write to [email protected] and include the text. A person will then review the contribution and add it if appropriate. Your right to take the matter to court remains unaffected.

Reporting illegal content

If you come across content on Parkonaut that you consider illegal, write to [email protected]. Say where it is (link or park and attraction), briefly explain why the content is illegal and give your name and email address. We confirm receipt, review the report and tell you how we decided.

Rights to your contributions

Only submit what you wrote yourself or are allowed to use. For accepted information about parks and attractions, such as opening hours, descriptions or technical data, you grant us a non-exclusive, free right without limit in time or place. We may store, edit, publish and pass on this information to others.

If you delete your account, accepted information that is not linked to you stays in the catalog. We delete your ratings and comments together with your account.

Suspension for abuse

If you abuse Parkonaut, we can block your access in whole or in part at any time. Abuse means any violation of the rules in “What is not allowed” or “User contributions”.

Depending on how serious it is, we remove individual contributions, block you only from posting new ones, or block your account entirely, for a limited time or permanently. We choose the mildest measure that works and also take your legitimate interests into account.

As a rule, we tell you beforehand what we hold against you, and you can respond. In serious cases, such as criminal offenses, attacks, a danger to others or circumventing a suspension, we block immediately and hear you afterwards.

We give you the reasons for every suspension in the app and on the website and, if we know your email address, by email as well. You can object there or at [email protected]. A person will then review the suspension again.

Even during a suspension you can export your data and delete your account. You may not create a new account during a suspension.

Ending your use

You can stop at any time by deleting your account.

We can terminate with two weeks' notice, for example if we shut down Parkonaut. Until then you can export your data. For good cause, especially in cases of serious abuse, we can terminate immediately (see “Suspension for abuse”).

Availability and liability

Parkonaut is free of charge for you. We may show advertising in the app and on the website. There is no entitlement to any particular availability or to particular features. Maintenance, security measures or technical faults may cause interruptions.

We may develop Parkonaut further at any time and in doing so change, restrict or discontinue features. Discontinuing the service as a whole is governed by the section “Ending your use”.

We compile the information about parks and attractions with care. Some of it comes from public sources and from users. We give no warranty that it is accurate, complete or up to date. Only the information and rules of the park on site are authoritative, in particular on opening hours, minimum heights and safety notices.

We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, and under the German Product Liability Act (Produkthaftungsgesetz).

If we breach an essential contractual obligation through slight negligence, our liability is limited to the damage that was foreseeable and typical for this kind of contract when it was concluded. Essential contractual obligations are those whose fulfilment makes the proper use of Parkonaut possible in the first place and on whose observance you may regularly rely. Otherwise, liability for slight negligence is excluded. These rules also apply to the personal liability of our vicarious agents.

Changes

If we change these terms, we will tell you in good time beforehand in the app and on the website. Material changes only apply to you once you agree. If you do not agree, you can delete your account, and we can terminate with two weeks' notice.

Minor adjustments that do not affect your rights and obligations, such as a new contact address, apply from the date of publication.

Governing law

German law applies. If you live in another EU country, you keep the protection of the mandatory consumer rules of your country.

We do not take part in dispute resolution proceedings before a consumer arbitration board (see the imprint).
